Last day of summer

Meteorological autumn begins at midnight local time, even though today's autumn-like temperatures will give way to summer heat for a few days starting Saturday. Tomorrow I will once again attempt the 42-kilometer walk from Cassie's daycare to Lake Bluff. Will I go 3-for-4 or .500? Tune in Saturday morning to find out.

High time for a schedule change

The Dept of Health and Human Services (HHS) has signed off on rescheduling THC as a Schedule III drug, the first of three steps required for marijuana to become just another medication:

A top official at the Department of Health and Human Services wrote Drug Enforcement Agency administrator Anne Milgram calling for marijuana to be reclassified as a Schedule III drug under the Controlled Substances Act, according to a letter dated Aug. 29 seen by Bloomberg News. This would mark a critical shift from its current status as a Schedule I substance, which includes drugs with a high abuse risk like heroin.

Assistant Secretary for Health Rachel Levine said in the letter that her recommendation was based on a Food and Drug Administration review of marijuana’s classification. The Controlled Substances Act places substances regulated under federal law into one of five schedules based on its medical use, potential for abuse, and safety or dependence liability.

HHS approval is one step in the process to rescheduling. The Drug Enforcement Administration also must sign off. The timeline is uncertain. But HHS Secretary Xavier Becerra recently said he hoped to have a decision for President Biden “this year.”

Cannabis companies and shareholders chortled with joy:

Cannabis stocks jumped more than 10% on news that the federal government is moving closer to reclassifying marijuana, which would cut taxes on companies at a time when they desperately need the cash.

Verano Holdings stock jumped 20% to $3.20 per share Green Thumb Industries shares rose 18% to $8.15 and Cresco Labs stock climbed 13% to $1.15.

Verano CEO George Archos said in a statement: “It’s about damn time.”

“We at Verano are incredibly excited to hear the news that the Department of Health & Human Services is calling for the rescheduling of cannabis to Schedule III,” the statement said. “For far too long, cannabis prohibition and its outdated status as a Schedule I substance have unduly harmed countless individuals affected by the failed war on drugs."

Rescheduling cannabis to a Schedule III drug would allow marijuana companies to claim the same types of normal deductions as other businesses, which would dramatically improve their financials at a time when even the largest companies are hurting.

It is about damn time. Schedule I drugs include heroin and LSD; Schedule III drugs include Tylenol with codeine, testosterone, and ketamine.

Not to mention, rescheduling cannabis would result in the cessation of Federal drug enforcement efforts against marijuana users and sellers, regardless of what party controls Congress or the White House. (Unfortunately for servicemembers, marijuana has its own special place in the Uniform Code of Military Justice. Article 112a will still enable the JAG corps to recommend dishonorable discharge for servicemembers caught with up to 30 grams of pot.)

Everything I love about movement conservatism in one story

The religious right's endless struggle to steal billions of dollars from American taxpayers to fund their own religious schools dovetails nicely with the penchant for right-wingers to steal millions of dollars from their own kind:

In recent years, [conservative Christianist lawyer Michael Farris] has reached the pinnacle of the conservative legal establishment. From 2017 to 2022, he was the president and chief executive of the Alliance Defending Freedom (ADF), a powerhouse Christian legal group that helped draft and defend the restrictive Mississippi abortion law that led to the overturning of Roe v. Wade. ADF and its allies have filed a flurry of state and federal lawsuits over the past two years alleging that public schools are violating parental and religious rights.

Yet it is outside the courtroom that Farris’s influence has arguably been most profound. No single figure has been more instrumental in transforming the parental rights cause from an obscure concern of Christian home-schoolers into a GOP rallying cry.

When former president Donald Trump called for a federal parental bill of rights in a 2023 campaign video, saying secular public school instruction had become a “new religion,” he was invoking arguments Farris first made 40 years ago. The executive order targeting school mask mandates that Virginia Gov. Glenn Youngkin (R) signed on his first day in office cited a 2013 state law guaranteeing “fundamental” parental rights that Farris helped write.

his most famous confrontation with public school officials came during a 1986 trial in Tennessee. His clients were born-again Christians who argued their children should not be required to read “Rumpelstiltskin,” “The Wonderful Wizard of Oz” and other material that they said undermined their religious beliefs.

A federal judge agreed, ordering that the children could opt out of the school’s reading lessons. But the decision in the case, Mozert v. Hawkins, was reversed by the 6th Circuit Court of Appeals, which ruled that merely exposing children to ideas did not violate their rights.

“We are simply clarifying a right that exists — a right which comes from God,” Farris said.

Make no mistake: Farris wants you to pay for Christian education. The whole "parents rights" angle is nonsense when you think about it. As one wag on Facebook put it, "I don't want my kids playing with those kids at a public park, so you should give me my share of the park district budget to build my own." And hey, it turns out, the ones making the argument usually have a sideline in private park development.

Even without the religious aspect, when natural monopolies emerge from civil society, the only thing that privatization accomplishes is to funnel money into people's pockets without improving the overall good. Health care in the US is the best example of this, but spending public money for private education is the same basic pattern.

It's yet another example of the religious right's continuing pattern of conflating their right to opt out of consuming public goods, which they certainly have, with a belief that they're somehow owed the equivalent value of the public good as their own private property. But that's not how civil society works. And I'll bet you all the money in my pockets against all the money in your pockets that Farris makes a great deal off the religious people he's convinced to follow him down this anti-social and destructive path.

I'm so tired of private interests taking public money for things that public organizations can do just as well, particularly if they stop having to fight for table scraps.

Should I retire to the Netherlands?

Not Just Bikes celebrates 5 years living in the Netherlands by raving about how the Netherlands' anti-car development patterns make just about every city in the country nicer to live than just about anywhere in North America:

I'm about 3/4 the way through Nicholas Dagen Bloom's The Great American Transit Disaster, having just finished the chapter on how Detroit's combination of racism, suburban/urban hostility, lack of vision, and massive subsidies for car infrastructure while starving public transit gave us the hollowed-out hellscape the city has become. This, after reading the chapter on how Atlanta's combination of racism, suburban/urban hostility, lack of vision, and massive subsidies for car infrastructure while starving public transit gave us the depressing echo of its former glory the city has become. And the chapter on how Chicago's combination of racism, suburban/urban hostility, and massive subsidies for car infrastructure almost—but not quite—overcame the city's history as the country's largest railroad hub with rail-driven suburban development along the Chicago & North Western and Chicago, Burlington & Quincy railroad lines.

Sigh.

I'm nowhere near retiring. And even though I work for an international company,  reporting up to the London office, my team are 100% Chicago-based for the time being. But when I'm old and decrepit 40 years from now, I imagine getting around a country that cares about its public transit might be easier than even one of the most transit-friendly cities in North America.

Worth the time

I tried something different yesterday after watching Uncle Roger's stab at adobo:

Ng's basic outline worked really well, and I got close to what I had hoped on the first attempt. Next time I'll use less liquid, a bit more sugar, a bit less vinegar, and a bit more time simmering. Still, dinner last night was pretty tasty.

Much of the news today, however, is not:

  • US District Judge Tanya Chutkan set the XPOTUS's Federal criminal trial for next March 4th, two years earlier than he wanted it.
  • Writing for The Guardian, Margaret Sullivan blasts Republican presidential wannabe Vivek Ramaswamy as "a demagogue in waiting," and a distressing preview of Millennial politicians.
  • The MiG pilot who ejected during an airshow on August 13th blamed the non-flying observer in the back seat for pulling the ejection cord on his own.
  • Chicago has struggled for 15 or more years to get critical repairs to our international dock on the South Side.
  • Elizabeth Spiers has a pretty good idea why Michael Oher, subject of Michael Lewis's 2006 book The Blind Side and the 2009 film of the same name, is pissed off at the white family that didn't actually adopt him.

Finally, via Bruce Schneier, a couple of kids with $30 worth of radio equipment managed to stop 20 trains in Poland by exploiting a mind-boggling weakness in Polish train dispatching equipment. Despite some media sources calling this a "cyber attack," it was nothing of the sort. The instructions for how to do this have existed for decades.

Big cats vs big dogs

This surprised me. One or more mountain lions in Washington state has decided that wolves taste good:

Washington Department of Fish and Wildlife (WDFW) staff have documented cougars killing six collared wolves since 2013—almost 30 percent of the 21 documented natural wolf mortalities in the state. "That's huge if that trend holds and is representative of the entire population [in the state]," says Trent Roussin, a WDFW biologist. The kills involve multiple wolf packs in different areas of Washington.

Such kills are rare elsewhere in the U.S. West, where more wolves are on the landscape since their reintroduction to Yellowstone National Park, which is mostly in Wyoming, and central Idaho in 1995. Today Montana and Idaho have over five times more wolves than Washington.

While a wolf pack tends to have an advantage over a single cougar—sometimes running it up into a tree or kicking it off a carcass to scavenge for themselves—a cougar excels in a one-on-one ambush. All but one of Washington's wolf kills involved lone wolves.

"Everyone always assumes wolves have the upper hand," says ecologist Mark Elbroch, the leader of Panthera's Puma Program. "But that's not always the case."

I don't expect my own wolf would do well in a fight against a cougar—or a Dachshund, for that matter—but I had no idea cougars hunted actual wolves. You know I'll always root for the dogs over the cats, though.

A "close call" in aviation isn't what you think

The Times posted an article Monday morning, complete with animated 3D graphics, guarantee to alarm most of the flying public. In short, when a non-pilot passenger hears "close call" they imagine the airplanes passing wingtip-to-nose at impossible speeds. When a pilot hears "close call" they mean the planes got within 2 km of each other—and sometimes 10 km qualifies. But the Times decided to go with the wingtip-to-nose meaning:

The incidents — highlighted in preliminary F.A.A. safety reports but not publicly disclosed — were among a flurry of at least 46 close calls involving commercial airlines last month alone.

They were part of an alarming pattern of safety lapses and near misses in the skies and on the runways of the United States, a Times investigation found. While there have been no major U.S. plane crashes in more than a decade, potentially dangerous incidents are occurring far more frequently than almost anyone realizes — a sign of what many insiders describe as a safety net under mounting stress.

So far this year, close calls involving commercial airlines have been happening, on average, multiple times a week, according to a Times analysis of internal F.A.A. records, as well as thousands of pages of federal safety reports and interviews with more than 50 current and former pilots, air traffic controllers and federal officials.

The FAA issued a fact sheet later that day:

Multiple layers of safety protect the traveling public, including: Traffic Collision Avoidance Systems on commercial aircraft, surface safety technology at the country's biggest airports, and robust procedures. Air traffic controllers and pilots all play critical roles.

The FAA maintains extremely conservative standards for keeping aircraft safely separated. Safety experts follow up on all events — even those in which no collision was imminent or even possible — and evaluate them for safety risks. The agency publishes this information on our website, updating it as new information becomes available.

In addition, the agency has hired 1,500 controllers for FY2023. This is in addition to the more than 2,600 controllers that are at various levels of training at air traffic facilities across the country.

We welcome scrutiny and look forward to the recommendations from the FAA’s independent Safety Review Team this fall.

Journalist and private pilot James Fallows also posted that maybe the Times needed to turn down the volume a bit, but yes, Ronald Reagan's legacy still haunts North American aviation:

My guess about the story is that the team members producing it have dealt with aviation mainly as passengers. That is, not as pilots, air traffic controllers, former staffers of any companies or agencies involved, “hangar rats” at small airports, or other roles with first-hand exposure to the strengths and weaknesses of the system.

This is not a criticism. As reporters we spend most of our time asking other people to explain things we haven’t seen or done ourselves, so that we in turn can explain them to the reader. That is what makes the job so absorbing and fascinating.

But in this case I notice a few points in the story that I think would get different emphasis from many aviators. I mention them for your consideration in reading this story and others that are sure to follow on the air-safety theme. I’ll mention three.

At several points the Times story warns about “loss of separation” dangers when planes are “in the skies and on the runways,” as in the passage I quoted above. Obviously a collision in either realm is disastrous. But the latter danger is so much more pressing than the former that it should be discussed and thought of on its own.

There is all the difference in the world between a “close call” that happens on a runway, versus one in the open skies. A runway is a relatively tiny strip of pavement onto which planes that are taking off and landing must converge. A plane sitting on the runway can’t quickly move out of another plane’s way.

By comparison, the sky is enormous. And even in the few places where it seems crowded, namely the approach lanes to major airports, there is vastly more room for a plane to maneuver quickly and avoid another plane’s path, and more robust systems to help them do so.

What the Times got right, though, is that the Ronald Reagan fired the entire air traffic controller union and the system has never fully recovered. The section of the Times article on controller scheduling should alarm people—but more for its effects on workers than its effects of aviation. Keep in mind, in the last 21 years and 10 months, the United States has had only two air transport fatalities out of over 18 billion passenger departures—and neither person died because of a collision with another airplane.

One more thing: the "not publicly disclosed" incidents in "a NASA database" refers to the Aviation Safety Reporting System, which is fully public and searchable. (You can even sign up for a free monthly newsletter!) The entire point of the ASRS is to make aviation safer by allowing pilots (and anyone else, for that matter) to report aviation safety problems without worrying about getting dinged. In fact, if a pilot reports his or her own error to ASRS before the FAA starts an enforcement action, the pilot is immune from fines and penalties from that enforcement, though she can still lose her certificate if the violation is egregious. The Times breathlessly reporting on a "secret database the FAA doesn't want you to know about!" just seems stupidly ignorant to a pilot, and misleading to anyone who understands journalism.

Anyway, the last time a transport airplane hit another aircraft flying over the United States was in 1987 (10 dead). The last one involving a jet airplane happened in 1978. And those accidents led to improvements in air safety that we continue to enjoy.

Incoming weather system

We get blizzards and heat waves in Chicago. Guess which one we get tomorrow? The forecast still calls for 36°C temperatures with heat indices around 42°C. But Inner Drive Technology World Headquarters is only 2.1 km from Lake Michigan. At Chicago's official weather station at O'Hare, which is 23.3 km from the Lake, it looks a bit grimmer: 37°C with a heat index of 43°C.

WGN's Tom Skilling and Bill Snyder admit that some of the models call for 38°C or 39°C, but they manually adjusted the forecast because the models don't all agree:

Temps at or above 100 in Chicago are rare. Since official records began in the city 153 years ago in 1871, there have only been 62 days with highs at or above 100 degrees. And at the Midway Airport site on the city’s South Side where weather observations have been archived since 1928, on only 92 occasions over that 95 year period has a reading of 100 degrees or higher occurred.

There’s a reason for the scarcity of such EXTREME HEAT. The fact is, nature finds ways to derail the development of such intense heat. That’s why as forecasters, we’re careful about predicting such readings and must ALWAYS MAKE IT CLEAR there are forces which have been around over the term of official weather observations which work to keep a 100-degree readings from happening. The best evidence currently available suggests a 99-degree high is a strong possibility Wednesday — a reading just one degree shy of a triple-digit reading and, if it occurs, a record breaker which would exceed the old August 23rd record Chicago high of 97 degrees. Thursday could see a 100-degree high, but the potential for a front to sag into the area and turn winds off the lake at some point in the afternoon isn’t completely off the table. ALSO, though not expected at the moment, the development of thunderstorms — even if close-by — can send a cooling outflow of air into the area aborting a 100-degree temperature.

What’s interesting is even if a cold front comes into the picture Thursday, the convergence of winds along that front can lead to heating which would be capable of sending Chicago-area highs to 100, which would tie the record for August 24 and become a windshift behind the front that would send temps falling.

(Note that WGN, unlike 95.6% of the world's population, still uses the obsolete Fahrenheit scale in its reports.)

In other words, 36°C is the low estimate for the heat we're about to get. If the temperature does get above 38°C, though, it will be the first time since July 2012 that we've experienced anything that hot here.

At least we have trees to shade our walks in my part of the city. Writer Tiffany Owens Reed lives in Waco, Texas, whose urban design she says better suits lizards than people:

Before the advent of air conditioners, hot weather was something that architects and city planners had to respond to with creativity. The weather was something to adapt to, to work with, to manage…not merely to escape. For example, in Bologna, architects responded to hot weather by building a network of covered walkways that allowed pedestrians to wander the city fully shaded except for the brief moments during which they crossed the street from one walkway to another. We can see a similar sentiment at play with the ornate covered passageways of Turin, Italy. In the U.S. when touring old cities like Charleston, South Carolina, we can see evidence of similar accommodations in the deep, wide porches circling old houses.

Seeing the city as a destination for humans to inhabit and explore, and as a conduit for experiencing nature would lead to different design priorities, similar to what we see with public splash pads, rivers cleaned up for public swimming, or railways turned into parks for lounging (as in the case of Manhattan’s Highline)

If the main assumption is that humans won’t be spending time outside, that discourages these kinds of weather-considerate features and what we get instead is what my husband and I have come to call “lizard architecture”: a homogenous style of design imported to cities by developers who lack regionally specific weather consciousness and that would probably be more conducive to designing for reptiles than for humans.

Lizard architecture might not be the most scientifically accurate name for this style of design, but it provides my husband and me much comic relief as we drive around, spotting massive, unshaded parking lots, exposed outdoor dining areas, and unshaded walkways…design features that make it extremely uncomfortable to be a human outside for extended periods of time. It’s the kind of design that indicates to me an overreliance on technology to solve our discomforts and an inability to imagine cities as spaces where folks might want to experience nature, even when it’s hot. More mindful, human-centric city designers would consider the possibility that humans actually want to be outside, not just as environments to move through as quickly and comfortably as possible.

Our heat wave should end Friday morning, with a cool front coming in from the north dropping temperatures as low as 16°C by Saturday night. Then we head into the last week of summer, with autumn officially beginning next Friday, when I plan once again to try walking a full 42.2 km.

Chuckles all afternoon

My home office sits at the top of my house as a loft over the floor below. I think it could not have a more effective design for trapping hot air. (Fortunately I can let a lot of that out through this blog.) This afternoon the temperature outside Inner Drive Technology World Headquarters didn't quite make 25°C, and it's back down to 23°C with a nice breeze coming through the window. Wednesday and Thursday, though, the forecast predicts 36°C with heat indices up to 43°C. Whee. (It gets a lot better Saturday.)

  • Speaking of authoritarians who hate the press, law professor Gregory Magarian digs into the Marion, Kansas, newspaper raid, which the Post says came about because the paper committed journalism on a corrupt police chief.
  • Rolling Stone helpfully catalogues malignant narcissist Elon Musk's biggest lies.
  • One of his lies, or at least one of his latest manifestations of abject incompetence at running a tech company, came earlier this week when he mused about ending the "block" feature on the app formerly known as Twitter, despite that move probably getting it kicked off the iPhone and Android platforms.
  • A judge sentenced an Ohio teenager to concurrent 15-to-life terms for killing her boyfriend and one of his friends by driving her car into a brick wall at 160 km/h.
  • American Airlines has sued Skiplagged, claiming the company tricks people into violating American's terms of service—and worse, doesn't actually save their customers any money.

Finally, a change to zoning laws in Auckland, N.Z., appears to have done what its proponents predicted: increasing housing and slowing rent increases. It's almost like single-family zoning was designed to keep those people out. Next thing, they'll start discover that zoning combined with redlining kept millions of credit-worthy people from ever building wealth for their families and led the US to an unsustainable pattern of urban development that will cost us trillions to fix. Crazy.
